Withholding FOI requests: In the Private Sector, that's fraud

It was with enormous interest I read on the Globe’s website about a conservative Ministerial Aide “unrealeasing” a document requested by The Canadian Press through an Access to Information request (The Access to Information Act ensures that citizens can request information about the government’s activities).

A federal cabinet minister’s aide killed the release of a sensitive report requested under freedom-of-information in a case eerily similar to a notorious incident in the sponsorship scandal.

What I find fascinating is the neither the minister (now at Natural Resources Canada) or the aide have been asked to resign.

Let’s be abundantly clear, if this were the private sector and a CEO was caught deliberately withholding material information from a shareholder… that would constitute either fraud and/or a violation of whichever provincial securities laws he/she was bound by. Moreover, such a crime that could carry with it a prison sentence.

And yet here, in the most cavalier manner, one of the most basic trusts that ensure accountability in our system is violated with almost no repercussions.

The story does have its dark humour (and a embarrassingly feeble attempt at an excuse):

Mr. Paradis’s current communications director said Mr. Togneri’s intervention was to suggest the Access to Information section offer fewer pages to the requester without charge rather than the entire 137 pages for a fee of $27.40, which had already been paid.

“He went through and thought that a huge section of a very big report wasn’t relevant and that you should be given the option of paying to get it or get the (smaller) chapter” without charge, Margaux Stastny said in an interview. “No one can overrule Access officers.”

The options were never provided to the requester, however. Instead, the department simply sent the censored report and refunded the fee.

Yes, I too am always comforted to know that my government is thinking of me and trying to save me a few pennies by ensuring I don’t see information they know I need not waste my time on.

I, of course, have another solution for how the photo copying money could be saved. What about emailing a digital copy of the report? Of course Access to Information requests (called ATIP or FOI for those in the US) are always handed out in paper, just to ensure you can’t do anything too useful with them… oh and to help ensure that they are late in delivering them.

So while, in this case, the Minister’s staff has committed an enormous gaffe – one that should have (and yet probably won’t) political implications, it is also a window into a broader problem:

FOI = broken.

I belong to a generation that gets information in .3ms (length of a google search) if you take 80 days to get my request to me (and edit it/censor it), you are a bug I will route around. This isn’t just the end of accountability in government, this is the end of the relevancy of government.

A Sad Day for Canadian Democracy

I, like many other people, was unsurprised but depressed to hear about the prorogation of Parliament yesterday. Lots has been written on it, much of it very intelligent, some of it not.

Andrew Coyne has a fantastic piece about how, as Radiohead would sing, you do it to yourself and that Parliament has consistently allowed itself to become irrelevant through a thousand small cuts. He is also correct in asserting that only its members can make it relevant again.

Kady O’Malley probably has the best insight in this interview. Why prorogue yesterday? Why not wait until when the House comes back in January in case some emergency arose that required Parliament’s attention. The unusual timing suggests the government wants to avoid letting committees or Parliamentarians do their work (mostly likely on the Afghan detainee problem).

On the less inspired side is conservative blogger Stephen Taylor. Stephen has good post and does as good a job as anyone can expect defending the indefensible. But ultimately, nothing he says counters O’Malley’s point. Moreover, his attempt to suggest that proroguing is constitutionally required (not even the PMO is making this claim) and that it is only those in Opposition who are acting politically is demolished by Ibbitson’s deadly and even handed column on the subject (very much worth reading).

Let there be no mistake, this is a political move.

Just as it was back in 2003 when (as Ibbitson rightly points out) Chretien prorogued Parliament in 2003 to avoid critics of the sponsorship program. Note this was also the time when Chretien’s popularity began to slide… So do people care about the Afghan detainee problem? No (just like they didn’t initially care about the sponsorship scandal). They DO care when their government ceases to be accountable, when it runs and hides from its mistakes. Doing so irrevocably hurt Chretien. It may end up doing the same to this government.

Either way, as pretty much every columnist seems to be saying, today our democracy is a little weaker, and Parliament a little less relevant.

The Valpy Social Media debate

So a few days ago I posted this response (a cleaner version to be found here at The Mark) to a piece Michael Valpy wrote in the Globe about how social media threatened the social cohesion of the country. My problem with Mr. Valpy’s piece is that it framed the question in the most negative light – seeing only the downside (and in some cases imagined) consequences of social media and none its positives. I was reminded of Steven Johnson’s delightful and intelligent counter-factual that describes a world where video games precede, and are then displaced by, books. One senses that if we lived in a universe where social media preceded main stream media Mr. Valpy would be writing columns worrying about the loss of the country’s small, rich and diverse conversations, crushed by the emergence a dominant agenda, curated by a small elite.

I was initially excited to hear that Mr. Valpy was writing a response in The Mark. Sadly, his piece wasn’t really a response. It addressed none of my critiques. Instead it focused primarily on repeating his original argument, but more slowly, and with bigger words.

I’ve re-read all three pieces and still feel good about my contribution. My main concern is that when reading the counterfactual at the end of my piece, many people have come to assume I look forward to the decline of main stream media (MSM). Nothing could be further from the truth. Yes, I believe in the potential of social media and, when I stepin  my counterparts shoes, I also see that MSM offers us a great deal. At the same time, I don’t believe MSM is the sole generator of social cohesion, national identity, or democracy. All three existed before the arrival of MSM and, should it come to pass, will survive its decline.

As a newspaper columnist I can imagine it is frightening to see your audience splintered into smaller fragments. At the same time however, I am surprised that a national commentator can’t see how unhealthy this imaginary social cohesion was, and how unsafe the public space was for many people. Remember, this is an article that paints, in a concerning tone, the passing of a world where people, to paraphrase Mr. Valpy, attended a modern version of Mass to become aware of what others thought they should be aware of. That is not a description of an active and engaged citizenry. That is a description of sheep. Well now the sheep are awakening. Yes it is scary, yes there are unknowns, and yes there is fragmentation. But there are also enormous positives, positives I wish Mr. Valpy and others at the Globe would include in their commentary. If they did they and their readers might see what I and those I work with see: the opportunity for something that it is better than what was on offer before, no matter how rosy a picture he paints of the past.

Ultimately, I think Mr. Valpy and I do share common ground. He sees “A glorious objective” in Michale Ignatieff”s call for a public space:

“Isaiah Berlin described this sense of belonging well. He said that to feel at home is to feel that people understand not only what you say, but also what you mean.”

I too believe this is a noble aim. But, while we stand on common ground, I fear Mr. Valpy and I look away in different directions (I would be interested in trying to reconcile these views – and have said as much to him). My reading of his piece leads me to believe that he looks into the past and posits that not only is such a state possible, but suggests we once achieved it. That there was a  Canada where people understood what one another were saying and meant, but that it is slipping away.

For me, I think any such past was more illusion than mirror.

I look forward and see not the realization of Ignatieff’s glorious objective, but an enhanced ability to pursue it. There are no countries where  people understand what each other say and mean. Only countries where citizens are good or bad at committing to try to understand what each other say and mean. In other words, home isn’t where you are understood, it is where others are prepared to go out of their way to understand you.

The opportunity of social media is it gives citizens – The People Formerly Known as the Audience – the ability to increase the range of views about which they want to be understood. This can lead to disagreements (such as the one the Valpy and I are having now) but it also forces us to face the fact that others do not understand, or agree, with what we say or mean. Whether it is disagreeing or agreeing however, the hall mark of social media has been its ability to expose us to new communities – to connect people with others who share interests and care about issues we’ve both long cared for ourselves, or have just discovered. As much as I like my country when its citizens are held to together by a common passport and newspaper, I like it even more when it is held together by a dense weave of overlapping, interconnected, conflicting and ever changing communities around hobbies, politics, personal interests, books, culture, and a million other things. Communities where new voices can be heard and new expressions of the Canadian identity can be manifested.

The promise of social media is its ability to complexify our story, and our relationships with one another. Ultimately, I see that complexity being much more interesting than illusions cast by crude mirrors reflecting only what their holders decide should be seen. Will social media be able to hold up some new “mirror”? I suspect yes, but ultimately don’t know. But whether it can or cannot, I feel optimistic that the ascendancy of social media doesn’t mean the end of our social cohesion.

Dear Valpy: social media isn't killing democracy, it's making it stronger

So I’m really worried I’m becoming the one man rant show about the Globe, but as long as their columnists keep writing stuff that completely misunderstand the intersection between technology and politics, I feel bound to say something.

First it was Martin Lawrence, who was worried about the future of the country since his profile of young people was (as my friend put it) limited to “an unthinking, entitled drain on the country I call home and pillage without contribution…”

Now Michael Valpy is worried. He’s actually worried about a lot of things (which don’t all seem to hang together, but the part that has him most worried is that Canadians are becoming segmented into smaller groups and that this threatens the fabric of our democracy and country.

The premise goes something like this: the decline of main stream media and the rise of social media means Canadians are suffering from a social cohesion deficit. Increasingly we will have less in common with one another and engage in narrower and smaller conversations. As a result, there will no longer be a “political agenda” we all agree we should be talking about. It is all summed with a quote from a Carleton University Professor:

“The thing about newspapers is that you always find things you didn’t know you were looking for. You come across views that you don’t agree with or don’t like,” says Christopher Waddell, director of Carleton University’s school of journalism. “When you’re searching for things on the Internet, I think it’s much less likely that you’re searching for things that challenge you. You’re much more likely to be searching for positive reinforcement.”

and it goes on…

“Society is always better when someone is trying to undermine your views. And particularly, social cohesion is better, because being challenged forces you to think through why you believe what you believe. It’s the stimulus for debate and discussion and a recognition of multiple others.”

What’s so frustrating is that Waddell and Valpy arrive to the debate both 3 years late and with the wrong conclusion. As Steven B Johnson, who wrote one of many fantastic pieces on “serendipity,” might ask: “Does Michael Valpy even use the internet?” But of course a main stream media columnist and a professor who trains them would naturally see a diminishing role for main stream media as a threat to democracy and the very fabric of the country. This argument has been tried, and frankly, it doesn’t have legs. Democracy and Canada will survive the decline of mainstream media – just as it survived before it existed.

Indeed, the decline of mainstream media may actually be healthy for our democracy. Here are two thoughts for Valpy to stew on:

First, comes from Missing the Link, a piece Taylor and I wrote ages ago which keeps proving to be handy:

The “necessary for democracy” argument also assumes that readers are less civically engaged if they digest their news online. How absurd. Gen Y is likely far more knowledgeable about their world than Boomers were. The problem is that Boomers appeared more knowledgeable to one another because they all knew the same things. The limited array of media meant people were generally civically minded about the same things and evaluated one another based on how much of the same media they’d seen. The diversity available in today’s media—facilitated greatly by the internet—means it is hard to evaluate someone’s civic mindedness because they may be deeply knowledgeable and engaged in a set of issues you are completely unfamiliar with. Diversity of content and access to it, made possible by the internet, has strengthened our civic engagement.

This strikes at the core of how Valpy and I disagree. To be harsh, but I believe fair, he is essentially arguing that we may be better off not only if we are dumber, but if we are collectively so. The country is better, stabler and safer if we all talk about the same thing (which really means… what does Toronto/Ottawa/Ontario insert favourite centralist scape goat here, want). Hogwash I say! Diversity is what makes Canada great, and it is, paradoxically, the thing that binds us. Certainly for my tribe the value of Canada is that you can come here and can be what you want. There is a common value set, but it is minimalist. The central value – now protected by the charter – is that you can be who you want to be. And that is something many of us cherish. Indeed, don’t underestimate the fact that that is pretty strong glue, especially in a world where there are many countries in which such a right does not exist.

Second, I think there is compelling case to be made that it is main stream media that is killing democracy. Virtually every political analyst agrees that ever since Trudeau the power of the Prime Minister’s office has been steadily increasing, more recently to a degree that arguably threatens the role and function of parliament. Do Committees matter any more? Not really. Oh, and name a regional MP who has real weight – someone on par to John Crosbie in his hey day. Pretty hard. What about Ministers? There authority (and accountability) is not even a slice of what it used to. And cabinet? Even it toes the line of the mighty all powerful PM.

What parallels this rise in the PMs absolute power? The increased used of modern technologies. TV and polls. With TVs the Prime Minister can speak directly to Canadians everywhere – without having to be mediated by pesky local MPs or representatives. And with polls, the prime minister doesn’t even need local MPs to give him or her the “sense on the ground.”  But imagine a world where the two very things that Valpy fears are in decline – polling and mainstream media – actually do disappear? With a citizenry fractured along hundreds of conversations there are all sorts of information niches for MPs to fill and play important roles within. More importantly, without effective polling MPs local knowledge and local community connections (enhanced by social media) suddenly becomes relevant again.

If anything polling and mainstream media (especially TV) were killing our democracy. Social media may be the reason we get it back.

The Canadian Government's War on Science

For those who did not catch this excellent piece in the Toronto Star I encourage you to take a look.

During the Bush era the Canadian war on science was an embarrassing side show to that of its more wildly offensive southern neighbour which regularly silenced scientists, withheld reports, or simply appointed “expert” panels whose credentials were dubious but whose members could be counted on to produce the “right” answer. Indeed, these sad events are well chronicled in Politics And Science In The Bush Administration drafted for Representative Henry Waxman. (This, as an aside, is what happens when you give elected representatives real research budgets – they look into all sorts of issues to keep the government of the day honest. A similar study by a Canadian MP would have stretched their resources beyond their limit).

But just in case you think the Canadian context is radically different, remember that our government has installed unqualified dependents of the oil industry to government scientific bodies. It has censored government scientists, preventing them from talking about their research at scientific conferences. It has barred officials from talking about climate change or harm reduction strategies for drug users. (It even banned one public servant from talking about a fictional book he”d written on climate change). It also disingenuously claims “more research is needed” on issues and then either cuts research programs that look into these questions or attempt to manipulate the process to produce outcomes that align with what they already believe (see the above Toronto Star piece).

This is the sad state of science and policy development in Canada. We alone in the world retain a government that is not interested in uncovering what is actually happening, but in fabricating a reality that conforms to an ideologically pre-determined world view. Our government’s two great allies, the Bush administration in the United States and the John Howard’s government in Australia, have moved on.

Today science is regaining its rightful place in the policy development process as evidenced by Obama’s inauguration speech:

The state of the economy calls for action, bold and swift, and we will act—not only to create new jobs, but to lay a new foundation for growth. We will build the roads and bridges, the electric grids and digital lines that feed our commerce and bind us together. We will restore science to its rightful place, and wield technology’s wonders to raise health care’s quality and lower its cost. We will harness the sun and the winds and the soil to fuel our cars and run our factories. And we will transform our schools and colleges and universities to meet the demands of a new age.

The mention is short and quick, but it was a powerful signal that, for scientists, the Bush era was over. Suddenly science mattered again in the United States. For the Canadian government this line is still more ominous. Their war on science can no longer hide in the shadow of Bush. And none to soon. As a believer in the power of effective public policy the undermining of science has been an attack on the effectiveness of good government. If our government doesn’t believe in science, how are we then to measure success, on what basis are we to decide which policies are more effective?

Oh, and don’t think the world isn’t noticing. You really have to work extra hard to prompt the world’s preeminent scientific journal – Nature – to write a special oped about how your government has become anti-science.

Tony Clement, who happily is not longer the Canadian Minister of Health received a swift rebuke for accusing doctors that work at Insite of being unethical.

Gary Goodyear Canada’s Scientific Minister is a creationist. Best response to this sad state of affairs is the incredulous Brian Alters, founder and director of the Evolution Education Research Centre at McGill University in Montreal. He noted this is akin to asking someone “‘Do you believe the world is flat?’ and he doesn’t answer on religious grounds…”

The Neo-Progressive Manifesto Prelude (or why Generation M must be remixed)

On Wednesday Umair Haque’s posted a Manifesto for Generation M. The post has received some praise and some serious criticism.

I’d be lying if I said the post didn’t resonate with me on certain level – heck, that is why I remixed it (lightly) on Friday night. Many of the manifesto’s ideas and links – and above all, its message of institutional failure – tapped into the challenges and issues Taylor and I sought to weave together in Progressivism’s End: How the Left is Killing Progressive Politics.

Now, at the end of the weekend, having reflected on it further alone, with friends and with Taylor, there is still lots I agree with. We do face a crisis of institutions and, frankly, there are a large number of people who would like to simply dial back the clock (some 10 years, others 35) and say – that’s it, problem solved. I believe Umair is saying that isn’t going to work. And I agree with him.

So having said that, I’ve got two observations and a final mega-remix to make to the Generation M Manifesto.

1. It Ain’t a Generational Divide

In reading the comments (especially this one) and talking with friends I was reminded how Taylor and I shied away from using a generational analysis like that adopted by Umair. This was an explicit choice. Our piece is about the death of progressive politics and what we believe is emerging in its place – it is the kind of narrative that, on the surface, appears to lend itself intuitively to generational divide. But the divide is not generational. First, let’s be honest, there are lots of Social Darwinian, self-centered, materially driven people in every generation.

Consider Canada, which many falsely believe is broadly immune to such thinking despite producing Mark Steyn. But consider the research in Sex in the Snow by Michael Adams. Drawing from his social values surveys, Adams concluded that Gen X could be divided into 5 “tribes.” Two of these tribes – the ‘New Aquarians‘ (13% of Gen Xers) and the ‘Autonomous Post-Materialists‘ (20%) would probably find the ideas in Umair’s Manifesto (as well as, hopefully, Taylor and I’s piece) resonate with them. However, among the other three ‘Gen X’ tribes, many of the ‘Aimless Dependents‘ (27%), the ‘Thrill-Seeking Materialists‘ (25%) and ‘Social Hedonists‘ (13%) would likely fall along a spectrum defined at one extreme by mild interest and the other by outright hostility. Still more would probably feel complete indifference to either Umair’s Manifesto or our piece.

This breakdown is true among Baby Boomers as well. I suspect that Autonomous Rebels (25% of boomers) and Connected Enthusiasts (14%) would be more inclined to identify with much of the Manifesto while Anxious Communitarians, (20% ) and Disengaged Darwinists, (41%) would be less inclined.

In short, a generational analysis simply isn’t accurate. But that is only the half of it. The other reason Taylor and I shied away from generational analysis because such an analysis is likely to hamper the development of a self-identifying and self-organizing group to champion and implement the ideas we (and Umair) highlight. While the Manifesto will inspire some, it’s analytical lens will, however, also alienate potential allies while simultaneously assuming those potentially indifferent or even hostile to its ideas are in agreement. If there is going to be a movement, it is wise to know who’s in, who’s out, and who doesn’t care.

2. It’s About Values

What is notably absent from Umair’s manifesto is any mention of values. It’s not that they aren’t there – it’s that they are left implicit. The values I see reflected in Umair’s post aren’t new; in fact they are quite old. This is the central piece to Taylor and I’s argument – that progressives have become more attached to the institutions they inherited than to the values those institutions were built to serve:

The rise of industrial capitalism during the 19th century led to a series of tense societal changes. These included the emergence of an urban working class, increasing inequality and the new possibility of total war. In response, three generations of pragmatically driven “progressives” emerged. Opposing both the socialist left and the laissez-faire right, they championed values such as equality of opportunity, meritocracy, government transparency and empirical inquiry.

This is the source of the crisis. It is not that one generation held values that another didn’t. It’s that the institutions we inherited don’t always reflect those values in a world where globalization, technology and social values have altered how we work, play and live. Taylor and I (and I suspect Umair) are frustrated because we see enormous time, money and energy being spent in an effort to architect our economy, our government and our public spaces to serve and preserve these institutions, rather than ensuring these institutions support us and an economy, government and public space we believe are essential for a prosperous and sustainable future.

So the question becomes how to ensure the values of equality of opportunity, meritocracy, government transparency, empircal inquiry – along with human rights, and the environment, get imbued into the policies, institutions, communities and companies we will inherit and create? It feels like the first step is to articulate them clearly. This way, when some of these new institutions begin to change we’ll know it is time to reform, abandon or simply move on.

3. Post-Potter Authenticity; and Where are the Women?

Finally, some quick hits. In a post-Rebel Sell world we need to be really careful about talking about authenticity. Even the “authentic” is constructed…  (If you haven’t read The Rebel Sell – go find a copy. Heath and Potter are brilliant).

Also, where are the women? Umair’s manifesto lists Generation Mers but there is almost nary a women among them. (I only counted one – Flickr had a female co-founder).

Gen M is about passion, responsibility, authenticity, and challenging yesterday’s way of everything. Everywhere I look, I see an explosion of Gen M businesses, NGOs, open-source communities, local initiatives, government. Who’s Gen M? Obama, kind of. Larry and Sergey. The Threadless, Etsy, and Flickr guys. Ev, Biz and the Twitter crew. Tehran 2.0. The folks at Kiva, Talking Points Memo, and FindtheFarmer. Shigeru Miyamoto, Steve Jobs, Muhammad Yunus, and Jeff Sachs are like the grandpas of Gen M. There are tons where these innovators came from.

I’m sure this is a problem that can be crowd sourced – but it had better happen quickly. In our piece, Taylor and I used Tzeporah Berman (Environmental Activisit), Calvin Helin (First Nations Lawyer) and Dan Florizone (Public Servant) as cases. Here I think is another place the manifesto could do with more examples – those doing work in the non-profit and government sector.

A real remix

Again – there are a lot of people who are going to jump on Umair. Indeed on some sites the Law of Fail has already been reached:

Once a web community has decided to dislike a person, topic, or idea, the conversation will shift from criticizing the idea to become a competition about who can be most scathing in their condemnation.

I’m not one of them. I understand why Umair is frustrated. I’m not certain that a generational analysis is the right approach but I do agree that we are not sufficiently wrestling with the question of how we redesign market regulation, democratic institutions, financial regulation, etc… to help foster the communities, environment and economy we want for the 21st century.

So with this in mind I’m going to take another cut at remixing the Manifesto. Indeed, it may be so dramatically different it is simply a re-purposing.  Increasingly, I sense that we’ve got to put values back into the equation and tackle figure out what are the cleavages in our society that do distinguish those opposed to reform from those in favour – in short, I’m going to remix it into a Neo-Progressive Manifesto.

Neo-Progressivism watch: online collectivism as the 3rd way that works

Just finished reading Kevin Kelly’s piece The New Socialism: Global Collectivist Society Is Coming Online in Wired Magazine. It talks about the same themes Taylor and I were trying to surface Progressivism’s End and I suspect we agree with Kelly’s in many regards.

Taylor and I talked about how the left (now old left) killed progressive politics and how progressive politics is re-emerging in new forms (I had wanted to use Mozilla as a mini-case, but came to it too late). Kelly’s piece deals less with the past and focuses exclusively on the nascent politics that is emerging in the online space:

We’re not talking about your grandfather’s socialism. In fact, there is a long list of past movements this new socialism is not. It is not class warfare. It is not anti-American; indeed, digital socialism may be the newest American innovation. While old-school socialism was an arm of the state, digital socialism is socialism without the state. This new brand of socialism currently operates in the realm of culture and economics, rather than government—for now.

When masses of people who own the means of production work toward a common goal and share their products in common, when they contribute labor without wages and enjoy the fruits free of charge, it’s not unreasonable to call that socialism.

Maybe. I think the socialism label takes the argument a bit far. Kelly’s piece portrays open source and collective online projects as disconnected from capitalism. Certainly in the case of open-source, this is a strained argument. While motivations vary, many people who fund and contribute to Firefox do so because having an open browser allows the web – and all the commerce conducted on it – to be open and competitive. Same with Linux, between 75%-90% of contributors are paid by their employers to contribute. As Amanda McPherson, director of marketing at the Linux Foundation notes: “They’re not the guys in the basements, the hobbyists.” Consequently, many open-source projects are about preserving an open platform so that value can shift to another part of the system. It is about allowing for better, more efficient and more open markets – not about ending them.

Still more difficult to believe is Kelly’s assertion that “The more we benefit from such collaboration, the more open we become to socialist institutions in government.” If there is one political philosophy that is emerging among the online coders and hackers it isn’t socialism – it is libertarianism. I see no evidence that socialism is making a comeback – this is where Kelly’s use of the term hurts him the most. If we are seeing anything it is the re-emergence of the values of progressive politics: a desire for meritocracy, openness, transparency, efficiency and equality of opportunity. The means of achieving this is shifting, but not back towards socialism of any form.

One area I strongly agree with Kelly is that neo-progressivism (or as he prefers, the new socialism) is strongly pragmatic:

On the face of it, one might expect a lot of political posturing from folks who are constructing an alternative to capitalism and corporatism. But the coders, hackers, and programmers who design sharing tools don’t think of themselves as revolutionaries. No new political party is being organized in conference rooms—at least, not in the US. (In Sweden, the Pirate Party formed on a platform of file-sharing. It won a paltry 0.63 percent of votes in the 2006 national election.)

Indeed, the leaders of the new socialism are extremely pragmatic. A survey of 2,784 open source developers explored their motivations. The most common was “to learn and develop new skills.” That’s practical. One academic put it this way (paraphrasing): The major reason for working on free stuff is to improve my own damn software. Basically, overt politics is not practical enough.

As we wrote in an early draft of Progressivism’s End:

Having lost, or never gained, hope in either partisan politics or the political institutions that underlie the modern state, much of this generation has tuned out.  Driven by outcomes, neo-progressive’s are tired of the malaise of New Deal institutions. Believing, but with a healthy dose of skepticism, in both the regulatory capacity of the state and the effectiveness of the market economy, they are put off by the absolutism of both the right and left.  And, valuing pragmatism over ideology, they are embarrassed by partisan bickering.

The simple fact is that in a world that moves quickly, it is easier than ever to quickly ascertain what works and what does not. This gives pragamatists a real advantage over theoretically driven ideologues who have a model of the world they want reality to conform to. Kelly may be right that, at some point, this neo-progressive (or new-socialist) movement will get political. But I suspect that will only be the case if a) their modes of production are threatened (hence the copyright was). I suspect they will simple (continue) ignore the political whenever possible – why get them involved if you can achieve results without them?

I don’t care whether newspapers live or die. It’s just a medium. (Yes, the singular of “media.”) It may well be it’s an outdated medium. It’s certainly a wasteful, expensive and environmentally harmful medium.

However, when newspapers die (so what? good riddance) the services that newspapers have traditionally supplied – such as serving as watchdogs for even the smallest municipalities, taxing bodies and so on – remain necessary to a functioning democracy. What happens when governments make decisions with no one watching?

And it’s tedious, people. Maybe some of you are experienced with this. Sitting through three-hour meeting of county commissioners, poring through stacks of facts and figures, following up to ask questions, finding alternate points of view – this is time consuming and not a whole lot of fun. When there are no reporters at these meetings, who will do this? Do you think it is no longer necessary? Will citizen journalists spend hours – unpaid – going line by line over the police board’s budget?

Well, according to Frances Bula, one of Vancouver’s finest journalist’s focused on local politics (she used to work at the Vancouver Sun, and now freelances for several publications, including the Globe and Mail) it is us who are covering this “small” stories. In a recent post entitled “When did civic politics get so interesting?” she states:

It’s hard to remember, but in those days, no one cared about city hall. It used to be me and a couple of Chinese-language-media reporters who would hang out in the pews at city council chambers on Tuesdays. When I went to the committee meetings on Thursday, I was usually the only reporter there. People coming to speak to council issues sometimes thought I was the recording secretary. And it was like that for quite a long time. Years and years, really, although Allen Garr started writing for the Courier after a while so then there was, thankfully, one more person.

This week in Vancouver, when city hall was stuffed like a turkey with news — the budget, cracking down on crummy SROs, whether to allow mixed martial arts events, police budgets being wrecked by gang investigations, Councillor Suzanne Anton grilling the mayor like he was a naughty boy about campaign financing — there were as many reporters and outlets covering the events as at any session of the provincial legislature…

…So, even though I now can’t get a seat at the media table these days if I come late to council, and it feels sometimes like everyone is falling over each other to get the latest little tidbit from the city, it’s okay — and even kind of fun — that it’s crowded.

But then this is what Shirly predicted would happen once the we understood the size of the cognitive surplus that is out there…

Articles I'm digesting at the moment

While I keep track of the books I’m reading to the right I don’t often get to talk about the articles I’m reading and loving. Here are a few I’ve stumbled over in the past week that I’m still digesting.

1) Via Mike T, Obama and the dawn of the Fourth Republic by Michael Lind on the cycles of American progress and why the next 36 years are going to be very exciting.

During the first 36-year period of a republic, ambitious nation-builders in the tradition of Alexander Hamilton strengthen the powers of the federal government and promote economic modernization. During the second 36-year phase of a republic, there is a Jeffersonian backlash, in favor of small government, small business and an older way of life. During the backlash era, Jeffersonians manage to modify, but never undo, the structure created by the Hamiltonians in the previous era.

2) Via Alo, Why Canada has to wait for it’s Obama Moment, by Jeff Roberts. A piece few Canadians would be willing to write about why the politics of Aboriginals and the rest of Canada remain separated.

In the case of black Americans, their ascension to the political mainstream came in part from leaving behind talk of rights and identity and embracing a postracial style of politics. Barack Obama’s rise has followed his willingness to move away from the swamp of identity politics.

It’s a thesis that parallels that of Calvin Helin’s in Dances with Dependency that I thoroughly enjoyed. Moreover, Roberts is only half right. There is an emerging generation of (particularly urban) First Nations who are going to transform the politics of both the First Nations community and Canada.

3) Via Jeff A, Printing The NYT Costs Twice As Much As Sending Every Subscriber A Free Kindle by Nicholas Carlson . Shocked? You should be. As the author concludes:

Are we trying to say the the New York Times should force all its print subscribers onto the Kindle or else? No. That would kill ad revenues and also, not everyone loves the Kindle.

What we’re trying to say is that as a technology for delivering the news, newsprint isn’t just expensive and inefficient; it’s laughably so.

Besides, think of the forests that would be saved.

4) Via Amy L, The $300 Million Dollar Button, by Jared Spool. As Amy said to me, “you’re a believer in small changes” which I am. Very often I find people jump for the big lever to create big change which often creates numerous unanticipated (and almost always unwanted) changes. I’m much more interested in finding the small lever that creates big change. This piece is about precisely one of those moments in the design of a webpage.

It’s hard to imagine a form that could be simpler: two fields, two buttons, and one link. Yet, it turns out this form was preventing customers from purchasing products from a major e-commerce site, to the tune of $300,000,000 a year. What was even worse: the designers of the site had no clue there was even a problem.

The murky future of BC-STV

I confess to reading, with great disappointment, Gordon Gibson’s comments about the upcoming referendum on STV:

“I have watched and taken part in our politics for more than 50 years,” former Liberal leader Gordon Gibson said.

“I have never seen such an opportunity,” he added.

I have. It was about 4 years ago. Something, Gibson briefly began to acknowledge before drifting back into platitudes:

“the last chance in the lifetimes of anyone in this room … a once-in-a-lifetime opportunity that we must not miss.”

Actually, this would be a twice in a lifetime opportunity, which is the problem.

Unlike in America, where ballot propositions are immediately binding, in Canada referendum’s have no legal relevance. That said, they remain an important source of legitimacy. Which is why the upcoming referendum on BC-STV is troubling. How legitimate is a referendum whose question was asked – and answered – a mere 4 years ago? Why is this referendum more valid than the last one? Why not – for example – take an average of the two?

Collectively, Canadians have endured this dilemma for decades. I remember being at a formal dinner, sitting beside a friendly Quebec sovereigntist who joked about how he would play squash with his good friend who happened to be a federalist politician. Sadly, he said, he lost every time. However, he quipped, he liked to remind his friend that he only had to win once…

Issues like the sovereignty of a province, or the structure of our electoral systems are not squash games, they are core questions about our identity and how we govern ourselves. Any proposal to alter or change them must be made through a process that bestows as much legitimacy as possible unto the new system. Pursuing a process in which you give yourself multiple kicks at the can, and deem valid the one time you reach the threshold does not accomplish this.

At least in Quebec the referendum question was separated by 15 years. This period of time meant it was possible to argue that there had been a generational change (true), that conditions had changed (also true), and that a similar, but new question could be asked once again (again, true).

The same cannot be said for BC-STV. It has only been four years, little has changed in terms of context and the exact same question will be asked.

While it supporters will claim that BC-STV is a better system (a topic for another post) derived from a legitimate process (something I believe to be contestable), the simple fact is voters rejected it a mere 4 years ago.

And herein lies the problem for BC-STV. It’s not clear there can be a positive result for its supporters. If they lose, they will be unhappy. However, if they win, what does it mean? Will the result carry sufficient credibility and legitimacy? What if it barely passes? Say 60.1%? My sense is that, barring an overwhelming or near unanimous vote – say 80% the result will be, at the very minimum, tainted. An ominous beginning for a process which all citizens should feel was enacted in a fair and legitmate manner.
